SAN FRANCISCO (Reuters) - A gay Lebanese man with AIDS (news - web sites) may seek asylum in the United States because he has a well-founded fear of persecution in his native Lebanon, a U.S. appeals court ruled on Monday.

The appeals court found Karouni's testimony about the torture and murder of a gay cousin to be compelling. Ramsey Khaleil survived being shot in the anus, apparently by the Shi'ite Muslim militia group Hizbollah in 1984, only to be shot to death, again apparently by the group in 1986.

Karouni said he would not be able to live in anonymity in Lebanon because seeking treatment for AIDS would invite persecution and because his homosexuality was known after being "outed" by a gay friend during a police interrogation in Lebanon in the mid-1990s.

"Karouni, by virtue of his past homosexual acts alone, would certainly face at least a 10 percent chance that he will suffer persecution," the appeal court ruled.
