White House Wants Gay-Policy Suit Tossed

WASHINGTON - The Bush administration on Monday asked a federal court to dismiss a lawsuit challenging the Pentagon's 11-year-old "don't ask, don't tell" policy.

The government said last year's landmark Supreme Court ruling that overturned state laws making gay sex a crime does not undercut the military's policy that allows gays and lesbians to serve as long as they abstain from homosexual activity and don't reveal their sexual orientation.

Courts previously have upheld the policy, approved by Congress and put in place by the Clinton administration.

Twelve gays expelled from the military because of their sexual orientation filed the legal challenge in December, citing the Supreme Court ruling that state laws making homosexual sex a crime were unconstitutional. That decision overturned an earlier Supreme Court ruling that had upheld sodomy laws.

1. Interesting....
I always noticed that sodomy between 2 men was illegal but the same act between a man and a woman are legal. Seems inconsistant if they truely uphold moral values.

3. it's not always legal between men and women.
and sodomy seems to change depending on where you live.

4. A few good men...
Sounds like a personal in the Washington Blade. Kidding aside, doesn't the military need all the smart, dedicated people it can get? In the post Abu Ghraib era, male soldiers having sex with each other seems kind of tame. Note to all the reservists whove been screwed by the back-door draft (no pun intended...)--tell 'em you're gay, so you can go home to your wife and kids.
