I was General Counsel for a presidential candidate who was in a similar legal situation on ballot access to Ralph Nader.

In 1976 I researched, designed and condicted the legal side of Gene McCarthy's independent bid for President. (I did much the same for John Anderson in 1980, but Anderson had much more money and many more volunteers, so the Anderson situation is not comparable.)

Based on the list of signatures and fees in this article, which are much milder than the burdens we faced in 1976, and in 1980, I expect that Nader will make the ballot in about three-fourths of the states. (McCarthy made the ballot in half the states. Anderson made the ballot in all the states.)

Both McCarthy and Anderson faced legal challenges in many states. Nader will face exactly the same, especially in thoses states where Bush and Kerry are apparently close, and Nader could represent the diffedrence.
