SCOTUS hands American Petroleum Institute its oily head on a platter



"Reuters) - The Supreme Court on Monday rejected a challenge by the oil lobby disputing a Environmental Protection Agency air pollution rule.

Various industry groups, including the American Petroleum Institute, originally challenged the 2010 regulation, which set a tighter Clean Air Act standard for short-term spikes in nitrogen dioxide pollution near roads.

The Supreme Court's decision not to take the case means the rule remains intact.

The agency said the new rule was justified due to scientific data that showed the health risks, particularly to those suffering from asthma."

EPA's budget has been cut to the point that it can't afford to establish a proper air monitoring network for Nitrogen Dioxide. Without a proper monitoring network you can't tell who is being exposed, can't establish areas that don't comply with the standard and therefore can't put any controls to alleviate any problems.

Bottom line, while it's nice to have rules they are meaningless unless you have the resources to fully implement them.
