Racine County sheriff will not enforce stay-at-home order, says it will have 'dire lifetime consequences'


Racine County Sheriff Christopher Schmaling issued a statement Friday saying his department would not enforce Gov. Tony Evers' safer-at-home order and said the "overreaching measures" would have dire consequences.

Evers on Thursday extended the safer-at-home order until May 26 in an effort to continue to slow the spread of the coronavirus throughout the state. The decision was met with opposition from Republican leadership in the state Legislature.

"The overreaching measures taken by State government will have dire lifetime consequences for businesses, homeowners, and families," Schmaling's statement reads.

"I took an oath to uphold the constitutional rights of our citizens and I can not in good faith participate in the destruction of Racine County businesses or interfere in the freedoms granted to all of us by our Constitution," he continued.

Removal by the Governor is a procedure that applies to county elected officials. The reasons for
which a particular official may be removed depend upon the office.
The Governor may remove certain county officials based on constitutional authority and may
remove others based on statutory authority. The Wisconsin Constitution provides that the
Governor may remove “any county elected official mentioned in” Wis. Const., art. VI, s. 4, except
for county clerks, treasurers, and surveyors. The county officials who can be removed under this
constitutional authority include district attorneys, sheriffs, registers of deeds, and chief executive
officers. The removal procedure requires that the Governor provide a copy of the charges and

So this conflict may just be starting between Gov. Evers and Sherriff Schmaling. We'll see who blinks first. It's a tough situation for Evers, but according to your post it seems that he can indeed remove Schmaling. We'll see if he steps up and does it.
