The National Audit Office has opened the door to an investigation into any agreement between EDF Energy and the Government over building the £14bn Hinkley Point nuclear plant.

Mr Morse, who produced a report into the Governments energy policy last year, said: I expect to follow up my earlier memorandum with further reviews to support parliamentary scrutiny of the Governments implementation of its energy policy and in particular I will consider the case for a review of the negotiation of the Hinkley strike price if one is agreed.
If the Government reaches agreement with EDF an audit could review the process and outcome of the negotiations and whether they have secured value for money. This could inform the continued management of the contract and provide lessons for future negotiations of the so-called contracts for difference.
EDF said it wants a contract that may be amended to protect it from events outside of its control that could have a significant impact on costs. It also said it is vital that any deal is protected against a future political change of heart.

In an open letter to the Sunday Telegraph, MPs and academics call for the National Audit Office to review nuclear negotiations between the Government an EDF Energy over financial support for the Hinkley Point C nuclear power plant in Somerset.

We need to know what kind of nuclear deal the Government is signing up to
The Department of Energy and Climate Change and the Treasury are negotiating with the French nuclear corporation EDF about the financing of possible new nuclear in the UK.
Through these negotiations, the Government is aiming to guarantee a set price for nuclear energy - a strike price.
This price will be well above the market price for electricity, meaning that UK taxpayer and energy consumer will be paying the difference. This contract will be locked in for very many decades up to 40 years.
The impact of this contract will be to shift the economic risk of building new nuclear facilities from the nuclear corporation to the consumer.
Because of commercial confidentiality, there will be very limited Parliamentary or public access to information about important details of these non-reviewable contracts.
Normally contracts of this scale and length would include provision for re-negotiation as and when circumstances change - and we need to know how and when these triggers would initiate.
We are also concerned about a lack of transparency around contingency budget arrangements for cost overruns and indexation.
For negotiations with such important outcomes, we are concerned that these talks lack the necessary democratic accountability, fiscal and regulatory checks and balances.
So, in the context of openness, transparency, fiscal and regulatory accountability, and best value for the UK taxpayer and energy consumer, we have joined together in requesting the National Audit Office to - as soon as possible - conduct a detailed review of the form and function of the negotiations between Treasury/DECC and EDF.

Set in the context of the proposed UK Energy Bill, ongoing Decc and Treasury negotiations with the French nuclear corporation EdF are key.
Through these negotiations, Decc are aiming to guarantee a set price for nuclear energy a strike price. The scale of the proposed Contract for Difference (CfD) is potentially very large, and it is understood that the length of the proposed contract may last for a very long time.
It is important to note that, because of commercial confidentiality, there will be very limited public or Parliamentary access to information about key details of these non-reviewable contracts.
For such key negotiations, with such important outcomes (potentially locking in UK taxpayers and energy consumers to a 35-40 year contract), there are concerns that these talks may lack the necessary democratic accountability, fiscal and regulatory checks and balances.
It is also argued that one of the main impacts of this contract may be to shift the economic risk of building new nuclear facilities from the nuclear corporations to the taxpayer and consumer. And these risks may prove very large.
Further, it is possible that these negotiations will be subject to EC Competition Directorate inquiry as to whether the outcome of these negotiations may prove to be in contravention to EU state aid legislation.
Therefore, in the context of openness, transparency, fiscal and regulatory accountability, and best value for the UK taxpayer and energy consumer it seems reasonable to suggest that these negotiations should be subject to an in-depth and timely review.
We understand that the NAO cannot investigate issues that Parliament has passed judgement on. However these negotiations are currently ongoing, and Decc plans to present their outcomes to Parliament before the relevant legislation has been passed. In this sense, the issue seems clearly to fall within the remit of the NAO.
We therefore join together in requesting the National Audit Office to at the soonest possible opportunity engage in a detailed review of the form, function and potential outcomes of the negotiations between Treasury/Decc and EdF.
Please regard this letter as an initial preparatory approach. We, and our Parliamentary and expert advisors would welcome a meeting with you in order to discuss this matter in much greater detail.
