Donald Trump yanks $5M Bill Maher lawsuit

Source: Politico

That multi-million dollar lawsuit against Bill Maher launched by Donald Trump?

It’s over … for now.

In February, POLITICO reported: “Donald Trump filed a lawsuit Monday in California against liberal comic Bill Maher, suing him for $5 million after Trump says Maher did not follow through on a $5 million public bet he made on ‘The Tonight Show.’” The bet concerned Maher’s statement that he would pay $5 million to a charity of Trump’s choice if the businessman provided a birth certificate proving that he’s not “spawn of his mother having sex with orangutan.” (It was a play on Trump’s demand last year that the president release his birth certificate and college records).

Michael Cohen, a top aide and lawyer to Trump, tells POLITICO that “the lawsuit was temporarily withdrawn to be amended and refiled at a later date.” The withdrawal of the suit was first reported by Deadline.

In other words, Trump concedes he is half-orangutan.

It was rather telling that he couldn't show us the original longform of his own birth certificate.

Thank you, Bill Maher, for shining the light of truth on this deceitful man-ape and his fraud against the American people.

He is a member of PETA, he certainly shouldn't be so cruel as to associate orangutans with such an odious and foul offspring such as Donald Trump, that is being very cruel to animals indeed.

I'm fairly certain Donald Trump was spontaneously generated by the swirling hatred and paranoia of the far right.

Chromosome testing at the least.

They used to let the child be shown to the jury in paternity cases to see if the child resembled the purported father. Donnie sure looks like a 'tan in some of his photos.

At least one report on this matter stated that this lawsuit was dismissed with prejudice http://www.deadline.com/2013/04/donald-trump-pulls-plug-on-5m-bill-maher-lawsuit/#utm_source=dlvr.it&utm_medium=twitter

The Celebrity Apprentice host had his lawyers file the request for dismissal with prejudice in LA Superior Court on March 29. Trump, whose NBC show hit a season low last night, first filed the breach of contract suit back in early February against the HBO host. He said that Maher broke a written promise that he’d give $5 million to the charities of Trump’s choice if The Donald could prove he wasn’t “the spawn of his mother having sex with an orangutan.”

If this lawsuit was dismissed with prejudice, then it can not be refiled. The statement from Trump's lawyer seems to indicate that this case was dismissed without prejudice.

Normally it is not a good sign to see a case dismissed or non-suited unless there is a venue or jurisdiction issue. It will be interesting to see if this case is refiled and if refiled, where. If this non-suit or dismissal without prejudice was for the purpose of changing the forum or venue, then Maher can use that against Trump. The non-suit could be for timing purposes, i.e. Trump does not want depositions or other proceedings to interfer with his TV show which is tanking in the ratings.
