TikTok To Sue Trump Administration Over Ban, As Soon As Tuesday

TikTok is planning to sue the Trump administration, challenging the president's executive order banning the service from the United States.

The video-sharing app hugely popular with the smartphone generation will file the federal lawsuit as soon as Tuesday, according to a person who was directly involved in the forthcoming suit but was not authorized to speak for the company. It will be filed in the U.S. District Court for the Southern District of California, where TikTok's American operations are based, the person said.

NPR has learned that the lawsuit will argue that President Trump's far-reaching action is unconstitutional because it failed to give the company a chance to respond. It also alleges that the administration's national security justification for the order is baseless, according to the source.

"It's based on pure speculation and conjecture," the source said. "The order has no findings of fact, just reiterates rhetoric about China that has been kicking around."

The justice department will be handling it from Trump's end.

The justice dept is claiming that Tik Tok has a security issue.

Really there isn't going to be much to see.
This happens from time to time. At issue is whether Tik Tok actually poses a security threat etc. And how serious is this security threat and whether an executive order can ban Tik Tok...stuff like that.

... from following news stories, an injunction is based on the
primafacie likelihood that the suit will succeed and whether or not irreparable harm would be done if the action was allowed to go forward before a judgement could be made. So I don't think discovery has anything to do with it.

As to whether it is severe or what the deal is, I don't know.

I've seen President Obama's executive orders gets shredded by the court.

Nothing happens except the order gets shredded. They aren't going to do anything to Trump. They aren't going to find anything salacious or anything weird. Either the order will stand or it won't.

This has nothing to do with China in 45's eyes. Think back to the 2011 White House Correspondents Dinner, when President Obama roasted 45 like a fat marshmallow. What we have seen for the last almost 4 years is such a deep hatred for that humiliation that he has literally tried to kill everything that President Obama gave life to.

Now, think about what our BRILLIANT kids did not so long ago when they made him look like an idiot by ordering nearly a million tickets to an event, just to humiliate him with a tiny turnout after his campaign bragged (and evidently believed) that they had that huge of a crowd willing to face exposure to a killer virus - a million people! - only to find out that they had been played by a demographic that they weren't counting on - our youth.

How was this giant hoax against 45 played out? Through TikTok.

So now, just like his plan to punish President Obama (and he could care less who he also hurts in the process), he is now going to take away the kid's toy and cancel TikTok.

There is nothing deeper to this that that. He is a playground bully and is getting even for what the youth did to him at that event.
