Republicans Sue California Governor Gavin Newsom, Claim Vote-by-Mail Order Is 'Illegal Power Grab'

The Republican National Committee, National Republican Congressional Committee and California Republican Party have filed a lawsuit challenging California Democratic Governor Gavin Newsom's recent executive order to mail every registered voter an absentee ballot ahead of the November election.
Newsom this month encouraged all voters in the state to cast their ballots by mail to avoid exposure to coronavirus. The move was met with strong opposition by President Donald Trump and members of the GOP. They claim that the order invites fraud and raises concerns that Democrats could use the ballots to swing races to benefit their party.
The lawsuit, filed Sunday in the U.S. District Court for the Eastern District of California, argues that Newsom "issued an executive order purporting to rewrite the entire election code for the November 2020 election cycle."
"This brazen power grab," the complaint continues, "was not authorized by state law and violates both the Elections Clause and Electors Clause of the U.S. Constitution.

(1,241 posts)like an absentee ballot. Because I enjoy going to the polls (and for some reason I really like getting that "I Voted" sticker), I have only used this options one in lo, these many year. So we usually have an extra step if we want to vote by mail. So Gavin Newsom decided that he would save Californians an extra three minutes and just send out the absentee ballots. So this is a "brazen power grab" because people are being robbed of the extra three minutes it took to get an absentee ballot before there was a plague?
November is a long time away in this time warp we live in now, but I will probably vote by mail in the fall. I will do what I always do, read the voter guide (it's pretty dense in California), puzzle over the math on the propositions, ask my neighbors with kids what they think about the school board candidates, and mark the ballot. Instead of taking my sample ballot to the polls, I'll stick the ballot in the envelope and mail it in.
I don't understand states that do not have the option of vote by mail. These seem to be the same states that are "consolidating" polling places, but I bet there is no "consolidation" in the (dare I say white) suburban districts. I expect tRump to slip up in some word salad around October and declare "ONLY I CAN RIG IT" in reference to the election.
So, yeah, I am outraged about this lawsuit. I hope that the judge dismisses it as the nuisance suit it clearly is, and that the RNC et al, pays court costs and a big honking fine for annoying us good people of California.
That said, I do hope Devin Nunes shows up to vote in person. I hope that his cow and his mom are in charge of the polls. I hope the polling place is in in a Donald porta-john tRump porta-john, and that there is no hand sanitizer or hand washing facilities available, as there were in my local polling pace in March. But in order to keep Devin safe, I hope he gets a giant dose of hydroxychloroquine and an injection of Clorox as he leaves the polls.
Yes, I am pretty angry - OK, I am very angry. However, I think back to the tRump tweet that just said "OBAMAGATE!" and I think back to the reply from Obama:
"VOTE!"
So I haven't lost hope. And yeah, I'll be there November 3rd, and I sure won't be voting for Donnie Tiny Hands.

(10,073 posts)already sent out mail-in ballots to all registered voters in the recent primary- including mine, Santa Clara, just shy of 2M people. In fact, California law currently (i.e., before Newsom's declaration) allows each county to opt for all mail elections. Maybe if Issa and Co. were more familiar with state election laws they could save everybody some time and money.

(13,582 posts)This is a nuisance law suit and the GOP should be fined for wasting the courts time. No doubt they will find some crooked Trump appointee judge to bend over and take it in the ass - but in the end this will go nowhere.
