The gates close but I believe that beach access is 24/7, you'll have to walk further, though. HappyPlace Jul 2015 #3

"As part of the permit requirements, however, the Ackerbergs were supposed to provide a public pathway to the beach, according to the Commission.

Instead, they paved over the easements with a 9-foot-high wall, large boulders, a fence and landscaping, leading to a lengthy legal dispute.

In 2013, commissioners were able to reach a “historic” agreement with the Ackerberg family that opened up the path to public access."

Not to defend these assholes, who should have been fined more stiffly, but the Coastal Commission rules are such that the entire coast is public property and I think access at night is fine except where prohibited due to state and national park rules, which are often sunrise-sunset hours of use.

I haven't been there in years, but if you can get to the beach by the pier, then you're free to walk along the entire beach. If you get locked in after sunset, you're not breaking any law but you'll have a longer walk to get back to the PCH or wherever you need to be.

Personally, I think there should be beach access and parking every 500 yards along great beaches like Malibu and private access, day or night, prohibited.

See www.coastal.ca.gov for more stories about restored and contested beach access.
