I am hoping that DUers will assist me on the conflict described in the below quote and link. (And that my computer skills are adequate enough to allow me to copy & paste it properly.)

"The property is a prospective site for shale gas exploration, drilling and extraction. The property owners have refused multiple offers to purchase or lease rights on the property to drill for shale methane gas. That is their private right. Beyond that right, the property,and specifically the portion of the property Antero Resources seeks to excavate and drill, has also been identified as a Native American Burial Mound site. In addition, evidence exists that other significant and historic anthropological findings on this site may be disrupted or destroyed if excavation and drilling are performed on the Bond property. It is in the best interests of the County, State of Ohio, and Nation, if Antero Resources, and the State of Ohio are prohibited from allowing the imposition of Eminent Domain to procure the property, or any other legal or civil action, including the voluntary sale and use of the property for excavation and drilling for the purposes Antero Resources requires to recover shale gas from this property. Specifically, no excavation below grade should be allowed, and no sub-surface drilling should be allowed which might disturb or destroy any burial sites or archological relics of whatever archeological age, on the Bond Property, for any purpose."
This information was sent to me a short time ago. I have been in communication with the Onondaga Nation, and with the Nation's attorney, this afternoon. The possibility of this leading to a federal court case is high, in my opinion.
We need as much support from the general public as possible. Please sign the petition, and -- iff possible -- send it along to other groups and individuals who may be interested.

(73,510 posts)This is stunning -- President Bush the Elder signed the Native American Burial Protection & Repatriation law 23 years ago. But I have half-expected the gas industry to try something like this.

(20,814 posts)working in tribal law, so I will have to ask him about the specifics of the Act, but my understanding of it is that it would certainly apply in this case and that any energy company will have a fight on its hands. Given the current Congress and Supreme Court, however, I wouldn't be surprised if a way was found around it for energy corporations.

(6,151 posts)Got next to no $ to spare, and the red state where I retired for affordability! is preparing to grab even more of my meager SS to finance a huge tax cut they want for corporations, but one thing they can't take away from me is petition signing and voting! Not yet anyway.

(17,086 posts)I'll try to remember to share any good feedback I get, as this puzzles me. eminent domain? And doesn't Ohio have burial protection laws? This should be protected six ways from Sunday by government regs, but the frackers have disturbed sites before with impunity, so maybe not.

Producing mass quantities of energy through fossil fuels is no longer desirable or necessary. Fossil fuel energy has proved to be unhealthy to the planet and unsustainable at present rates of consumption. The human race needs and deserves a better, renewable and sustainable source of energy. It is time to stop heeding the calls of the Fossil Fuel energy to allow them to drill wherever they find a gallon of oil or a pound of coal. We must not allow them to pretend or to persuade us, the American people, that renewable technology is a dream that will only be realized in the distant future. It is available now, while fossil fuels will be deploeted in the not-too-distant future.
It is time to declare the preservation of a Native American Burial Mound is more important than the corporate well-being of Antero Resources or any other fossil fuel producer. It is an industry that must be replaced by a sustainable energy industry, the sooner the better.

Native Americans quit talks on Keystone XL pipeline
Leaders of Native American tribes have pulled out of talks with US federal officials to express their outrage over a planned oil pipeline and the contamination of their ancestral lands as a result of the project.
The leaders from 11 tribes walked out of a meeting in Rapid City on May 16, and called on US President Barack Obama to engage in direct negotiations with them over the Keystone XL pipeline.

(1,269 posts)running the gas lines, and even then it is generally only used for interstate transportation. I've yet to hear of a case for eminent domain to get drilling rights.
Then again, the lines they put in are pretty disturbing, they're going in all over where I am in southeastern Ohio.
