One of the BIG questions surrounding Washington and Colorado marijuana users is whether legalization of medical marijuana and even pot for recreation means employees are protected from being tested and fired for using the drug.
The Colorado Court of Appeals gave the first answer today: Nope.
Although it was well understood from the beginning that I-502 would not give Washington workers who use marijuana legal cover, the issue of medical marijuana and workers seems more subtle.
The I-502 fact sheet states plainly: I-502 does not change Washington state employment law, which allows for employment drug testing in some situations.

Saw this coming a mile away. We can fire people for smoking cigs in their own home and they drug test for tobacco, so pot has no way to avoid the same thing.

Unless your boss knows you smoke and wants a easy way to fire your ass, which I've seen happen-

(17,086 posts)Once you're on board they only test for cause in most industries. Even when I was in the Army, when the First Sergeant was told to supply three "random" guys for testing you could be sure that they would be the three shitbirds at the top of his list, not anyone he didn't want to risk losing.
