He spoke. He said the word, "no."

She then asked him whether he could afford an attorney.

It was the only time that Tsarnaev, who was shot in the neck, made any sound. “No,” he said.

Good. Maybe he'll be able to say even more at his next hearing.

The Obama administration invented it a few years ago. It is not a law and would likely not hold up in the Supreme Court.

The Supreme Court decided the exemption could be used way back in 1984.

The supreme court ruled in 1984 that an exemption can be made for any immediate threats. The Obama administration a few years ago greatly expanded that to this '48 hour rule' where they believe they can ask them about anything they want. It is not a law whatsoever, it goes far beyond what the Supreme Court said was OK, and it was created by the Obama administration.

They didn't say they could be questioned for 48 hours. They didn't say the could ask them questions about anything not related to immediate threats. The Obama DOJ created these rules a few years ago.

I'm glad Tsarnaev has gotten his Miranda rights but Jonathan Turley pointed out today that's been a mere formality. There's a mountain of evidence that's being developed to link him and his late brother to the bombings and murder of the MIT officer...not much he can or can't say that could further incriminate himself. Also it was announced that a public defender has been assigned so Tsarnaev will have legal representation.

Via ACLU Blog of Rights...

In our democracy -- a nation of immigrants -- the thing that binds us together is not a common language or race or religion, but our commitment to certain inalienable rights. The right to remain silent. The right to confront your accuser in a court of law. The right to be presumed innocent until proven guilty. Self-evident truths. It all began in Boston -- when a group of brave colonists resisted the yoke of a despotic king and sought freedom. Protecting Tsarnaev's constitutional rights is the best tribute we could give to the storied legacy of that great city where our freedoms and rights first took hold.
