CISPA, the Fourth Amendment and You

CISPA is designed to let the federal government work with private companies to fight hackers and cybercriminals in and outside of the United States. As part of the effort to detect cyber threats, private companies could voluntarily share with the government data about Internet users.

The sharing could be done in "real time" as the cybercops try to defeat and track down the evildoers. Companies could also share data among themselves as part of the effort.

There are major drawbacks about the legislation, say CISPA's critics. The privacy provisions for consumers, they claim, are vague or nonexistent. The government and companies can't look at your personal data, such as medical records and tax returns, if they are part of the "data dump" that is shared in real time. But the law doesn't require that companies excise, or edit out, that information in the transfer process.

Another criticism is that a warrant isn't needed for the government to obtain that information. And companies that share your information won't be held legally liable for sharing that information, a practice that seemingly conflicts with privacy policies on existing websites.

CISPA's biggest critic in Congress is a representative from Colorado, Jared Polis. The Democrat told the House on Wednesday, "This is the biggest government takeover of personal information that I've seen during my time here in Congress."

Whatever President Obama wants is fine by me.

BTW, with regards to privacy remarks on sharing on the net.
When one goes into a parking garage, there are signs that state the garage is not liable.
That is just to attempt to bluff the people if their cars are damaged or stuff is stolen.
Of course one can still file suit and win lots of money.

Everyone thought Zucky was a friend(not me). And people show all their dirty underwear and secrets.

But whatever President Obama wants is fine by me.

As said, though, its odd timing as the NRA now uses the 4th more than the 2nd, since people started being wise to them and wanting the 2nd reinterpreted.

The funny part is, they already know anyhow. Maybe it would be best to be transparent on the books.

And the wording makes it such that one doesn't know all the caveats if it happens/doesn't.
So I leave it to wiser hands than mine (President Obama/Eric Holder) and abide by their decision.Because there might be stuff in it like that poison pen amendment was in the gun bills.

Surely you're not fine that Obama has more warrantless wiretapping than Bush?

Okay, what about this one... Obama wants to assassinate American citizens. Fine by you?

Obama prosecutes whistleblowers, you're fine with that too?

Geez, you need to cut out that blind allegiance and think for yourself. He's not as great a human being as you seem to think he is. You shouldn't hand over your ethics for anyone else to dictate what they will be.

If you are concerned with the state of our country you should learn to think for yourself and not put blind allegiance into any other human being. Especially not one with Obama's track record. Most especially any Republican, but we were talking about your blind faith in Obama so...

And the tearing down of President Obama will directly lead back to Jeb Bush.

Myself, I would rather continue the agenda of President Obama long after his 8 years is up.

I foresee an 80-20 nation in doing that.

(about an interparty fight where I think 60% of their party is not interesting in believing in the far right and they too are looking to make the break)


comes a point when one needs to stop fighting a perceived war and bring everything together

Instead of fighting the 50% of the people of this country that are in their party,
why not take 60% of that 50% and bring them together with us?

and leave their fringe 15-20% to be left with nothing

At that point, anything we want can be ours. If you can see past the immediate day into the long range prize, which is what our President is doing now.(and hopefully that which shall follow immediately after him in 2017.

remember the people across the street don't necessarily believe in the people the republicans elected to office. They are as much a prison to them, as we are.

What is going on
CISPA, or The Cyber Intelligence Sharing and Protection Act is a bill that has just passed the House of Representitives and is currently working its way through Congress.

CISPA is a bill focused on Cyber Security. It's meant to address growing concerns for Cyber threats and give protection to businesses who handle your personal information. The number one threat to your personal information is malicious attackers, and it costs much more to defend from attacks than to initiate them.

CISPA puts more tools in businesses' hands, but it brings into the question of security vs privacy.
So, what exactly is a Cyber Threat?

(A) IN GENERAL- The term ‘cyber threat information’ means information directly pertaining to--

(i) a vulnerability of a system or network of a government or private entity;

(ii) a threat to the integrity, confidentiality, or availability of a system or network of a government or private entity or any information stored on, processed on, or transiting such a system or network;

(iii) efforts to deny access to or degrade, disrupt, or destroy a system or network of a government or private entity; or

(iv) efforts to gain unauthorized access to a system or network of a government or private entity, including to gain such unauthorized access for the purpose of exfiltrating information stored on, processed on, or transiting a system or network of a government or private entity.

(B) EXCLUSION- Such term does not include information pertaining to efforts to gain unauthorized access to a system or network of a government or private entity that solely involve violations of consumer terms of service or consumer licensing agreements and do not otherwise constitute unauthorized access.
Well that's well and dandy, why should I be concerned?
While CISPA was written to address a legitimate problem, there are concerns about it potential for misuse. It could allow private companies to share your personal information with other companies and the government without informing you of it. The wording that relates to what information can be shared is vague, which raises concerns about what personal information of yours will be shared. The bill has been changed over time to address some of these concerns but most privacy advocates feel that it still has large loopholes that could be abused.
