I'm totally kidding by asking that question. The politics is so obvious. In my opinion, the politics overwhelms the legality. You don't have to agree with that, but if you think it's ALL about the law, and public safety and whatever, you are in denial, which is something that is not unheard of here.

(27,461 posts)there are sensible reasons to hold him as an enemy combatant. We're not hearing them now that it is Lindsay Graham's idea. If it becomes Obama's idea, that's when we'll start hearing the sensible reasons for that.

(27,461 posts)they see his citizenship as a technicality, especially since he was born abroad. They say, "he renounced his citizenship when he attacked the United States". Lots of arguments available to the people that choose to support enemy combatant status.
