Lindsey Graham doesn't think the bomber should get a Miranda warning.

L'il Lindsey, who has a law degree, has also said he thinks Tsarnaev - who is a naturalized American citizen - should be tried by a military tribunal and not a civilian court. Lindsey's law school should rescind his degree, or at least make him take Con Law 101 over.

Now, the WSJ’s Evan Perez has gotten his hands on Obama’s new policy. While the WSJ didn’t print the full text, here is a taste:

A Federal Bureau of Investigation memorandum reviewed by The Wall Street Journal says the policy applies to “exceptional cases” where investigators “conclude that continued unwarned interrogation is necessary to collect valuable and timely intelligence not related to any immediate threat.” Such action would need prior approval from FBI supervisors and Justice Department lawyers, according to the memo, which was issued in December but not made public.

Mr. Holder proposed carving out a broad new exception to the Miranda rights established in a landmark 1966 Supreme Court ruling. It generally forbids prosecutors from using as evidence statements made before suspects have been warned that they have a right to remain silent and to consult a lawyer.

He said interrogators needed greater flexibility to question terrorism suspects than is provided by existing exceptions.

The proposal to ask Congress to loosen the Miranda rule comes against the backdrop of criticism by Republicans who have argued that terrorism suspects — including United States citizens like Faisal Shahzad, the suspect in the Times Square case — should be imprisoned and interrogated as military detainees, rather than handled as ordinary criminal defendants.

he's suggesting Obama has a different position when he knows full well he doesn't. Every news story which doesn't include Obama's position, as you have, has failed.

Also, anyone who criticizes Graham for this position better be willing to criticize Obama.

As Glenn Greenwald pointed out, if the notion is worth mocking now, people should have been mocking Obama and Holder two years ago.

or elsewhere? IF the police arrest him here on US soil, he should be arrested and tried like everybody else. I don't think that President Obama is talking about hauling this guy off to Gitmo for a military tribunal, is he? Currently, the only person suggesting this is Graham, no?

it's a phony issue raised by the conservatives and Obama caved to take the issue away from them. Some people are ok with that because they identify most closely with Obama's political interests. Others care more about civil liberties, such as the ACLU representative quoted in the article.

Starting with, oh, all the fucking evidence and ending with him tossing another pressure cooker bomb at the cops.

It may not matter if they give him a Miranda warning, a Carmen Miranda warning, or what. Dude is fucked.
