(16,191 posts)In the majority of these cases, the police do not pursue charges because they realize there's insufficient evidence to actually get any kind of conviction. DA's know the score, and they don't like to waste their time with cases they consider to be unwinnable. They know what the standard of evidence is to secure a rape conviction, and the tragic reality is that a huge number of rape cases do not provide that level of evidence. The arrests after the suicides aren't a response to the evidence, but to public pressure.
While it's nice to see an arrest, most of the boys in these cases will end up going free at the end of the day because of lack of evidence. This is doubly true in the cases where it was essentially the victims word against the attackers, because the victim is no longer available to testify or refute her attackers claims. Their defense attorneys will weed out any prospective jurors who may be sympathetic to the idea of a "dead rape victim", leaving only the jurors who will focus on the evidence. In most of these cases, without a victim to testify, there simply won't be enough evidence to lock them away.
In the case of this latest young woman, her attackers won't even be publicly shamed. California law will prevent their names from ever being released, and their juvenile court records will be sealed.
