During the Supreme Court's gay marriage arguments in March, a Justice Department lawyer named Sri Srinivasan urged the justices to kill the anti-gay Defense of Marriage Act.
The Senate this week will consider Srnivasan's nomination to the federal appeals court in Washington, D.C., arguably the most important appeals court in America. That hearing will be a "dress rehearsal" for Srnivasan's eventual nomination to the Supreme Court, The New Yorker's Jeffrey Toobin argues today.
President Obama will almost certainly get to pick the next justice, as 80-year-old cancer survivor Ruth Bader Ginsburg, a liberal, will likely retire before his term is up. (If she stays on the court, she would run the risk of being replaced by a Republican president.)
The D.C. Circuit, which is important because it directly hears any challenges to federal agency rules, is considered to be a gateway to the Supreme Court. It's likely Obama is pushing Srnivasan's nomination through because he wants him to get to the high court, Toobin writes.

(1,763 posts)Srinivasan also is known for having represented former Enron executive Jeffrey Skilling in his appeal before the U.S. Supreme Court, Skilling v. United States (2010).
Skilling v. United States, 561 U.S. ___ (2010), was a United States Supreme Court case interpreting the honest services fraud statute, 18 U.S.C. § 1346. The court held, in the case involving former Enron CEO Jeffrey Skilling, that the honest services fraud statute, which prohibits "a scheme or artifice to deprive another of the intangible right of honest services", covers only bribes and kickback schemes.

(57,936 posts)agreeing or disagreeing with a client. Everyone is entitled to a defense. You are entitled to a lawyer when accused of a crime. Doesn't mean your lawyer approves of what you may have or may not have done.

I don't expect Obama to appoint leftists to the courts, but a liberal nominee would be a welcome surprise.

(52,130 posts)Brennan and Marshall as well as Stevens tended to pick very liberal clerks while Scalia and Thomas pick very conservative ones. O'Connor may have been less interested in ideology than in writing ability. Frankly I have no idea. I would like to know that before this guy replaces a true liberal such as Ginsburg.

(90,189 posts)Sri Srinivasan is an Indian-American, as in, born in India, raised in Kansas. He's young, only 46 y.o. Betcha he won't be impressed by the Opus Dei justices, either.

Srnivasan, the Justice Department's principal deputy solicitor general, is an appealing candidate for the high court. He has a lot of Supreme Court experience and a moderate background. He has argued 20 cases before the high court and clerked for now-retired Justice Sandra Day O'Connor.
