So Lindsey Graham is saying that if

Lanza's mother had gifted him her gun or sold it to him that it would make no sense to do a background check? Wouldn't a background check on him have stopped him from owning a gun? That should be reason enough to include guns handed down in families requiring a background check.

the argument that their shouldn't be a background check because it's a relative is mind numbingly stupid.

Only federally licensed dealers have access to the background check system, called NICS. So if a dealer sells a new or used gun, it goes through NICS.

Some states put all transfers through a federal dealer (FFL), some states put all handgun sales through an FFL, and some states have their own background check system.

I don't know if a background check would have stopped Fuckwad; he would have had to have a felony conviction, a domestic abuse conviction (felony or misdemeanor) or be involuntarily committed to a mental institution. I think a restraining order also disqualifies a person.
