A Man Coughed on a Wegmans Employee. Now He’s Charged With a Felony.

The man, George Falcone, 50, of Freehold, N.J., was shopping for groceries at a Wegmans store in Manalapan, N.J., on Sunday evening when a worker asked him to move away from her and a food display because he was too close, the state attorney general, Gurbir S. Grewal, said on Tuesday.

The authorities said that Mr. Falcone leaned in close to the worker to cough and allegedly laughed, telling her that he was infected with the virus. Mr. Falcone later told two other store employees that they were lucky to have jobs, officials said.

The second charge stemmed from Mr. Falcone’s refusal to provide his name and driver’s license for 40 minutes to a police detective who had been part of a security detail at the supermarket, the authorities said. Mr. Falcone was also charged with harassment, they said. The authorities did not say whether Mr. Falcone actually has the virus.

Mr. Falcone would face up to seven years in prison and a fine of up to $26,000 if convicted on all charges, the state attorney general said.

Assuming the death penalty is off the table, I'd push for guilty and sentencing of this fool to the maximum provided by NJ law. Not just a fine, and not a weekend in jail, but serious prison time. I'd ask for the full seven years -- but would settle for a year. Oh, and a fine, again the maximum that New Jersey State law allows.

(Juries, I know, do not set the amount of prison time or fines -- but they can recommend, I think, and let the judge do with it what he/she will.)

But man oh man would I like to sit on this man's jury.

who is sick and who is not. This does constitute an attack, an assault upon another person. Good for the NJ authorities. I hope (1) that the store bans the a&&hole from their premises forever, being that he's so disrespect of others.

That store's employees will recognize him in the future, but other Wegman's locations probably won't.

I hope he does get convicted on the felony charge. What he did is an act of domestic terrorism. And, even if he does not have signs or symptoms of the virus, he might be carrying it for all he or anyone else knows.

Only firm, quick consequences will stop these ignorant fools from terrorizing people in public.

ON EDIT: Ultimate irony and karma if the guy gets convicted, does some time, and catches the virus in jail.

I didn't register to DU to police other DU members. I came here to DU to be with like minded progressives who have compassion, understanding and integrity. I do my part with alerting suspicious posts and I complete jury duty when I'm selected for it.


I don't know why this has to be an issue but it's irrelevant and I'm done with you.

I had a great-great grandfather, lived to be 107. He was a prodigious drinker and a mean drunk, so they built him a shack deep in the woods. Whatever kid was in the doghouse that week had to take him a sack of food, which they'd dump at the door and then run like hell so he couldn't catch them. When there were a couple of full sacks of food untouched, the family went out to bury him.

That was the story, anyway.

A variation of that needs to be done now, house arrest for these social clods who think their freedumb gives them a right to hurt other people. Suburban sprawl makes woods hard to come by, so house arrest will have to do.

This terrorist should be locked up, maybe not 7 years but for 2+ months. When released, his arms and ammunition should be confiscated, and during his parole he cannot enter a store without a mask AND gloves.

I'm sure similar incidents have happened since then.

I bought some plants from Home Depot today and had the most wonderful experience. 100% masking. Plenty of social distancing and people following the signs on the floor. Customers were polite to the staff, who were patient with customers as it's a tense time for everyone. And several police cars roaming around the parking lot because there was also a grocery store and target and fast food options nearby.

I'm glad George Falcone was charged with something. The OP says felony. Some other articles at the time said he was charged with terrorism.

that, for the safety of employees and other shoppers, customers must wear face masks when inside the store. They also have hand sanitizer at every entrance and throughout the store.

This guy was just being a gigantic trumpkin (asshole) and should never have been inside in the first place. I report shoppers without masks to employees and they escort them from the premises. These trumpkins make my blood boil.

The more accurate ones with the long swabs deep up your nose. Even with the more accurate test, there is a high % of false negatives, so several consecutive tests are needed. And if he turns out he's positive, he should be charged with attempted murder.

a ShopRite on Staten Island, employees who saw it but didn't dare step in were not exactly on the side of the mob even though they wear masks and need all the protection from others they can get. They said that the hoodlums chased the woman and obviously weren't afraid of her and that one apparently felt his mask was in his way because he pulled it down to scream at her.
